Terms and Conditions

1. Scope

These Terms and Conditions apply to the public website, the Nexin account and the digital comparison, analysis, consultation and insurance intermediation services of Nexin Group GmbH. Specific terms shown and accepted for an individual service take precedence over these Terms and Conditions.

2. Services and Nexin’s role

Nexin provides information, comparisons and digital tools and may, at your request, provide insurance advice and insurance intermediation. Results are based on the data entered and the product and tariff information available at the relevant time. They do not guarantee acceptance, coverage or a premium offered by an insurer.

An insurance contract is concluded exclusively between you and the relevant insurer.

3. Registration and account security

Certain functions require a personal account. You must provide accurate, current information, protect your access credentials and notify us promptly of suspected misuse. You are responsible for actions performed through your account where you initiated them or where they result from a culpable breach of these duties.

4. Digital communication and declarations

You agree that Nexin may provide contract-related information through the platform and to your registered email address. Legally relevant declarations and mandates are valid only through the channels specified in the relevant process. Electronic copies may be used as evidence of communication.

5. Your duties during comparison, consultation and application

You are responsible for complete and truthful information, especially risk, health and contract details in insurance applications. You must review applications, quotations, product information and policies before approval and report apparent errors promptly. Incorrect or incomplete information may lead an insurer to reject, amend or deny benefits under a contract.

6. Costs, compensation and cashback

Unless otherwise agreed in the relevant process, customers pay no separate fee to Nexin. If intermediation is successful, Nexin may receive acquisition or portfolio compensation from the insurer. The type and amount or calculation basis is disclosed before a binding application is submitted.

Cashback is due only where expressly promised in the specific offer and subject to the conditions shown there. The process states the amount or calculation, due date and possible adjustments if the intermediated contract is not concluded, cancelled or charged back.

7. Permitted use and intellectual property

Unlawful, misleading or abusive use and automated access that impairs security or operations are prohibited. Content, marks, software, designs and databases are protected in favour of Nexin or their respective owners and may not be exploited beyond the limits of applicable law without permission.

8. Availability and liability

We operate our services with appropriate care but do not guarantee uninterrupted availability or freedom from errors. Third-party content and external links are outside our responsibility. Nexin has unlimited liability for loss caused intentionally or through gross negligence and where liability is mandatory by law. Otherwise, liability is excluded to the extent permitted by law. Decisions should not be based solely on non-binding website or comparison information.

9. Duration, suspension and termination

You may terminate your account through the available account functions or by notifying us. Nexin may temporarily suspend or terminate accounts in the event of misuse, security risks or material breaches. Statutory retention duties and mandates that remain effective are unaffected.

10. Changes to these Terms

We may amend these Terms for objective reasons, particularly if services or the law change. We notify registered users of material changes in an appropriate form. Where renewed consent is required, we obtain it before continued use of the affected service.

11. Governing law and jurisdiction

Swiss law applies. Mandatory statutory venues apply to consumers. In all other cases, the place of jurisdiction is Lachen SZ.
